1. Application Preparation

Generally 1 week

Based on our strategy session, we prepare your application with close attention to the details that affect protection, owner information, description of goods or services, filing basis, and examples of how your mark is used. Presenting your mark clearly and accurately from the start helps reduce avoidable issues and gives your application a stronger foundation entering USPTO review.a

2. Filing & USPTO Review

Generally 1 week to file; review timeline varies

Once your application is ready, we file it with the USPTO and monitor it throughout the review process. A USPTO examining attorney reviews your application to determine whether it meets the legal requirements for registration.

What an Office Action is. The USPTO may issue an Office Action raising formalities, substantive refusals, or both.

How we respond on your behalf. If a formalities-only Office Action is issued, our response is generally included in your flat fee. Responses to substantive Office Actions are billed separately.

3. Registration

Generally 12–18 months for use-based applications; up to 3 additional years for intent-to-use applications
